Welcome to AetherDrop! By accessing or using our website, application, and file transfer services ("Service"), you agree to be bound by these Terms of Service. Payments and global tax compliance are handled by our Merchant of Record.
1. Acceptance of Terms
AetherDrop provides a direct, peer-to-peer file transfer protocol. By using AetherDrop, you confirm that you have read, understood, and agreed to these Terms, as well as our Privacy Policy.
2. Description of Service
AetherDrop facilitates the transfer of files between users' devices via direct peer-to-peer connections and encrypted relay servers. We do not host, store, or monitor the contents of the files transferred.
- Free Tier: Includes unlimited file sizes and maximum P2P speeds, with a capped fallback relay allowance.
- Pro Tier: Includes expanded features like Turbo Relay, unlimited folders, and multi-device support for a recurring subscription fee.
3. Acceptable Use and Restrictions
You agree to use AetherDrop only for lawful purposes. You are solely responsible for all content you transfer. Because of our end-to-end encrypted architecture, AetherDrop does not have the technical ability to monitor or intercept your files. However, you must NOT use AetherDrop to:
- Transfer or share files that are illegal, infringe upon intellectual property rights, or violate copyright laws (including DMCA-protected content).
- Distribute malware, viruses, ransomware, or any malicious code designed to harm devices or networks.
- Transfer content that promotes violence, terrorism, child exploitation, or illegal acts.
- Attempt to reverse-engineer, exploit, or disrupt the operation of the Service, the signaling server, or the relay infrastructure.
Copyright Policy (DMCA): AetherDrop respects intellectual property rights. While we cannot scan your private P2P transfers, we will respond to valid notices of alleged infringement and reserve the right to terminate accounts of repeat infringers.
4. User Accounts and Subscriptions
To access Pro features, you must create an account and pay the required subscription fees.
- Billing: Fees are billed in advance on a recurring schedule. You may cancel your subscription at any time, but no refunds will be issued for partial billing periods unless required by law.
- Account Security: You are responsible for safeguarding your account credentials. AetherDrop is not liable for unauthorized access resulting from your failure to secure your account.
5. Privacy and Encryption
Your privacy is central to AetherDrop. Files are encrypted end-to-end and never stored on our servers. For details on how we handle metadata and account information, please refer to our Privacy Policy.
6. Disclaimer of Warranties
The Service is provided on an "AS-IS" and "AS-AVAILABLE" basis. AetherDrop makes no warranties, express or implied, regarding the reliability, speed, or availability of the Service. We do not guarantee that file transfers will be error-free or uninterrupted, as performance depends heavily on the users' network hardware and ISP conditions.
7. Limitation of Liability
To the maximum extent permitted by law, AetherDrop and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Service.
You acknowledge that AetherDrop is merely a conduit for data transfer and holds no liability for the content, loss, or corruption of files sent between peers.
8. Changes to the Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify users through our website or application. Continued use of the Service after changes are published constitutes your acceptance of the new Terms.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AetherDrop operates, without regard to its conflict of law principles.
